These Terms & Conditions (“Agreement”) govern your use of This Is Playa (“Platform,” “we,” “us,” or “our”).

This Is Playa is owned by Generational Integrity Trust and managed by Polymath Genius Media.

By accessing or using this website, purchasing tickets, features, or memberships, you agree to be legally bound by these Terms.

If you do not agree, please do not use the Platform.

1. Nature of the Platform

This Is Playa is an event promotion and community platform that:

  • Promotes events
  • Facilitates ticket sales
  • Offers promotional features for creators
  • Offers memberships

We may act as:

  • Event organizer, or
  • Promotional intermediary on behalf of third-party event hosts

Event details will specify the responsible organizer.

2. Eligibility

You must:

  • Be at least 18 years old
  • Have legal capacity to enter into binding agreements

By using this Platform, you confirm that you meet these requirements.

3. Ticket Purchases

A. Payment Processing

Payments are processed through secure third-party payment processors.

  • We do not permanently store payment details.
  • Payment information is used solely to complete transactions.

B. Pricing

All prices are listed in the applicable currency and may include applicable taxes unless otherwise stated.

We reserve the right to modify pricing at any time prior to purchase.

C. Refund Policy

Unless otherwise stated on the specific event page:

  • All ticket sales are final.
  • Refunds are not guaranteed.
  • In the event of cancellation by the organizer, remedies may include rescheduling, credit, or refund at our discretion.

If an event is postponed, tickets remain valid for the rescheduled date.

4. Memberships

Memberships may include access to exclusive content, discounts, or community benefits.

By purchasing a membership:

  • You agree to any recurring billing terms disclosed at checkout.
  • You may cancel future renewals before the next billing cycle.
  • No partial refunds are provided for unused membership periods unless required by law.

5. Promotional Features

If you purchase a promotional feature (such as event highlighting or business placement):

  • You confirm you have rights to all submitted content.
  • You grant This Is Playa a non-exclusive license to display your content on our platform and marketing channels.
  • We reserve the right to refuse or remove content that violates our standards.

6. User Conduct

You agree not to:

  • Use the Platform for unlawful purposes
  • Upload false, misleading, or infringing content
  • Attempt to interfere with platform security
  • Engage in harassment, hate speech, or abusive conduct

We reserve the right to suspend or terminate access for violations.

7. Intellectual Property

All platform content, including:

  • Branding
  • Logos
  • Text
  • Design
  • Graphics
  • Website structure

is the property of This Is Playa, Generational Integrity Trust, or licensed providers.

You may not reproduce, distribute, or exploit content without written permission.

8. Assumption of Risk – Events

By purchasing a ticket or attending an event:

  • You voluntarily assume all risks associated with attendance.
  • You acknowledge that event environments may include inherent risks.
  • You agree that This Is Playa is not liable for injuries, losses, damages, or theft occurring at events, except where required by law.

Event organizers are independently responsible for event execution and safety.

9. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for indirect, incidental, special, or consequential damages.
  • Our total liability shall not exceed the amount paid by you for the specific service giving rise to the claim.

Nothing in these Terms excludes liability where prohibited by applicable law.

10. Data Protection

Your personal data is processed in accordance with our Privacy Policy.

We comply with:

  • Mexico’s Federal Law on Protection of Personal Data Held by Private Parties (LFPDPPP)
  • EU General Data Protection Regulation (GDPR), where applicable

By using the Platform, you consent to such processing.

11. Force Majeure

We are not liable for delays or failure to perform due to circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters
  • Government restrictions
  • Public health emergencies
  • Civil unrest
  • Venue closure

12. Termination of Access

We reserve the right to suspend or terminate your access to the Platform at our discretion if you violate these Terms.

13. Governing Law & Jurisdiction

This Agreement shall be governed by the laws of Mexico.

Any disputes shall be subject to the competent courts of Mexico, unless mandatory consumer protection laws in your country of residence provide otherwise.

If you are located in the European Union, you retain any mandatory rights granted under EU consumer law.

14. Modifications to Terms

We may update these Terms at any time.

The updated version will be posted with a revised “Last Updated” date. Continued use of the Platform constitutes acceptance of any changes.
